At Elevating Art, we strive to provide excellent service and deliver high-quality products. In the event that a client wishes to cancel an order or request a refund, the following terms and conditions will apply:

1. Retainer Payments

  • General Retainer Agreement: For clients who engage in retainer agreements, the retainer fee is a non-refundable deposit paid upfront to secure services for a specified period or project.

    • Retainer fees are applied toward the total cost of the project, and the balance is due upon project completion or according to the agreed payment schedule.
    • If a client cancels the project before the agreed services are completed, the retainer fee will be forfeited to cover any preparatory work and services already provided.
  • Monthly Retainer Payment Program:

    • For ongoing projects or clients requiring consistent monthly services, Elevating Art offers a Monthly Retainer Payment Program. Under this program, the client agrees to pay a set fee on a monthly basis for ongoing access to specific services.
    • The monthly retainer fee secures the client’s place in the service schedule and guarantees the availability of the company’s resources for the agreed-upon period.
    • Service Delivery: The Monthly Retainer Payment Program covers a set number of hours or services each month. If the client requires additional services beyond the agreed scope, extra charges may apply, and these will be billed separately.
    • Payment Terms: Payments are due at the beginning of each month and are automatically billed unless otherwise specified. Failure to make payment on time may result in suspension of services until payment is received.
    • Cancellation of Monthly Retainer:
      • If the client wishes to cancel the Monthly Retainer Payment Program, a notice period of [insert notice period, e.g., 30 days] is required. If the client fails to provide notice, they will be billed for the following month.
      • If the client cancels the agreement before the end of the month, no refund will be issued for the remaining days of the month, as the payment secures the services for that period.
    • Unused Services: The Monthly Retainer Payment Program does not allow for the carryover of unused hours or services to the next month. Any unused services are forfeited at the end of the month.
    • Renewal: The Monthly Retainer Payment Program will automatically renew at the end of each month unless canceled by the client or Elevating Art.

2. Cancellations by the Client

  • Prior to Service Delivery: If the client wishes to cancel a project before any services have been delivered, they must notify Elevating Art in writing.

    • Retainer-based Projects: The client will forfeit the retainer fee, as it compensates for securing time, resources, and initial planning.
    • Non-Retainer Projects: If a non-retainer project has been started and materials have been purchased or work has been initiated, the client will be required to pay for the completed portion of the project.
  • After Service Delivery: If the client decides to cancel after the delivery of services or products, no refunds will be provided. The client remains responsible for the payment of the full project cost, as services have been rendered.

  • Cancellation of Monthly Retainer Payment Program:

    • If the client wishes to cancel their Monthly Retainer Payment Program, they must provide written notice of cancellation at least [insert notice period, e.g., 30 days] before the end of the current month.
    • During the notice period, the client will be billed for the full month’s services, and Elevating Art will continue to provide services as agreed.
    • If the client fails to provide the required notice, they will be billed for the upcoming month, and services will continue until the end of that month.
    • If cancellation occurs in the middle of a month, no refund will be issued for the remaining days of that month, as the payment secures services for the full month.

3. Refunds

  • Non-Refundable Fees:
    • Retainer fees, setup fees, and deposits are non-refundable.
    • Once a project has commenced, all payments made toward the project are non-refundable due to the time, resources, and materials already committed to the work.
  • Refund Requests for Errors or Defects: If there is an issue with the final product due to an error on Elevating Art’s part (e.g., defective products or incorrect designs), the client must notify us within [insert number of days, e.g., 7 days] of receiving the product. Elevating Art will:
    • Provide a replacement product or service free of charge or issue a partial refund, depending on the extent of the error.

    • Refunds are not provided for client errors, such as incorrect design submissions, spelling errors, or changes requested after the product has been finalized or delivered.

4. Early Termination of Retainer Contracts

  • If the client wishes to terminate a retainer agreement early, they must provide written notice of cancellation. The cancellation notice must be given at least [insert notice period, e.g., 30 days] before the end of the current service period.
    • Before Services Rendered: If no work has been done during the service period, the client will be entitled to a refund for any unused portion of the retainer, minus any applicable administrative fees or work already completed.
    • After Services Rendered: If work has already been completed during the service period, no refund will be provided for the remaining balance of the retainer.

5. No Refunds for Custom and Personalized Items

  • Custom-designed items, personalized products, or services that are uniquely tailored to the client’s specifications (including but not limited to vinyl cutting, sublimation prints, and custom 3D prints) are non-refundable once production has begun.

6. Force Majeure

  • Elevating Art will not be held liable for any delay or failure to deliver services or products caused by events beyond our control, such as natural disasters, pandemics, or other unforeseen circumstances. In the event of such delays, the client will be notified promptly, and any applicable deadlines will be adjusted.

7. Dispute Resolution

  • Any disputes regarding cancellations or refunds will be resolved through direct communication between the client and Elevating Art. If a resolution cannot be reached, the matter will be handled through [arbitration/mediation] in accordance with the laws of [your state or country].

8. Amendments to the Policy

  • Elevating Art reserves the right to modify or update this Cancellation and Refund Policy at any time. Clients will be notified of any changes via email or other communication channels. Continued use of our services after changes to the policy constitutes acceptance of the new terms.
