Terms and Conditions for Elevating Art

1. Introduction These Terms and Conditions govern the use of services provided by Elevating Art (“we,” “our,” or “the company”). By engaging with our services, you (“the client” or “you”) agree to be bound by these terms.

2. Services Offered Elevating Art provides the following services:

• Vinyl Cutting: We specialize in creating custom designs for T-shirts, signs, decals, and other vinyl-based products.
• Sublimation Printing: We offer sublimation printing services for various materials and products.
• 3D Printing: We provide 3D printing for part development and other custom designs.
• Custom Crafting: We work on personalized crafting projects, including custom prints, decorations, and more.
• Consultation Services: We offer consultation for design and crafting projects to help bring your ideas to life.

3. Payment and Pricing

• Payment for services is due upon agreement, either before or after project completion, depending on the scope of the service.
• Prices are subject to change based on the complexity and materials required for each project.
• Custom orders require a non-refundable deposit, with the remaining balance due upon completion or before delivery.

4. Client Responsibilities

• Clients are responsible for providing accurate specifications, artwork, and information needed to complete their project.
• Any delays or errors caused by incorrect or incomplete information may result in additional fees or delays.
• Clients must ensure they have the legal rights to any images, logos, or designs submitted for their projects.

5. Intellectual Property

• All designs and artwork provided by Elevating Art remain the intellectual property of the company unless otherwise agreed.
• Any custom designs created for the client will be the property of the client once the final payment is made, subject to any licensing restrictions for use.
• Clients may not reproduce, resell, or distribute any materials or products created by Elevating Art without permission.

6. Delivery and Shipping

• Delivery times will be provided at the time of order placement and are estimates. Elevating Art is not responsible for delays caused by shipping carriers.
• Shipping fees are the responsibility of the client, and charges will be added to the final invoice.

7. Refunds and Cancellations

• Once a project has started, cancellations may result in a partial refund based on the work completed up to that point.
• We do not accept returns on custom-designed items unless there is a manufacturing defect or error on our part.

8. Limitation of Liability

• Elevating Art is not responsible for any indirect, incidental, or consequential damages arising from the use of our services or products.
• Our liability is limited to the amount paid by the client for the specific service or product in question.

9. Privacy and Data Protection

• We value your privacy and will only use personal data in accordance with applicable privacy laws.
• Information collected from clients will be used solely for processing orders, communication regarding services, and improving our business.

10. Termination of Services

• Elevating Art reserves the right to terminate services or contracts if the client breaches any part of this agreement or engages in unethical behavior.

11. Governing Law

• These terms and conditions shall be governed by and construed in accordance with the laws of South Africa.

12. Changes to Terms

• Elevating Art reserves the right to update or change these terms at any time. Clients will be notified of significant changes.
